Common Types of Personal Injury Cases in North Dakota

  • Car Accidents: Motor vehicle collisions are one of the leading causes of personal injury in North Dakota. These accidents can result from factors such as distracted driving, speeding, drunk driving, or reckless behavior on the road.
  • Truck Accidents: Accidents involving commercial trucks, tractor-trailers, and other large vehicles can cause catastrophic injuries due to their size and weight. Truck accidents often result from driver fatigue, improper maintenance, or violations of federal safety regulations.
  • Motorcycle Accidents: Motorcyclists are particularly vulnerable on the road and may suffer severe injuries in accidents caused by negligent drivers, road hazards, or defective motorcycle parts.
  • Medical Malpractice: Patients can suffer harm due to medical errors, misdiagnosis, surgical mistakes, medication errors, or inadequate care by healthcare providers, including doctors, nurses, hospitals, and other medical professionals.
  • Nursing Home Abuse: Elderly residents of nursing homes and assisted living facilities may be subjected to abuse or neglect, leading to physical injuries, emotional trauma, or wrongful death. Common forms of nursing home abuse include neglect, physical abuse, emotional abuse, financial exploitation, and inadequate care.
  • Premises Liability: Property owners have a legal duty to maintain safe premises for visitors. Premises liability cases may arise from slip and fall accidents, trip and fall accidents, inadequate security, dog bites, or other dangerous conditions on residential, commercial, or public property.
  • Product Liability: Manufacturers, distributors, and sellers can be held liable for injuries caused by defective or dangerous products. Product liability claims may involve defective design, manufacturing defects, inadequate warnings, or failure to recall unsafe products.
  • Oilfield Injuries: North Dakota's oil and gas industry poses significant risks to workers, including exposure to hazardous materials, equipment failures, fires, explosions, and other workplace accidents. Injured oilfield workers may be entitled to compensation for their injuries under workers' compensation or personal injury law.
  • Wrongful Death: When a person dies as a result of another party's negligence, surviving family members may pursue a wrongful death claim to seek compensation for their loss. Wrongful death cases can arise from car accidents, medical malpractice, workplace accidents, or other fatal incidents.

If you or a loved one has been injured in any of these types of accidents or incidents, it's crucial to seek legal representation from an experienced personal injury lawyer. An attorney can help you understand your rights, navigate the legal process, and pursue the compensation you deserve for your injuries and losses. Don't hesitate to reach out to Maring Williams Law Office for trusted legal advocacy in Jamestown, ND, and the surrounding areas.

How Much Time Do I Have to File a Personal Injury Lawsuit?

Each state has its own statutes of limitations, or time limits, for filing personal injury lawsuits. In North Dakota, you generally have three years from the date of the accident/injury to file a personal injury lawsuit. If you were hurt but did not immediately discover your injury, you have two years from the date you discovered or should have reasonably discovered the injury to file suit. If the at-fault party is a government entity, you have just two years to file a lawsuit. If you miss the deadline, you will be unable to bring a claim and will be unable to recover compensation for your damages.

Do not wait to contact our firm. The sooner you reach out to us, the sooner we can get to work on your case.
