Declaratory & Injunctive relief

Class Action and Disability Rights

Our firm was involved in a landmark class action on behalf of North Dakota children and adults with development disabilities. ARC of ND challenged the treatment and conditions at the Grafton State School (later named the Developmental Center) and the lack of community facilities and options across the state. We were awarded declaratory and injunctive relief establishing the legal rights to which people with disabilities were entitled. The court order created a comprehensive system of programs, services and facilities for the plaintiff class, and dramatically improved the conditions and opportunities provided to them. The changes required under the court order took nearly 16 years to implement, and North Dakota became recognized as a leading state in the provision of services to children and adults with disabilities. ARC of North Dakota v. Olson, 561 F. Supp. 473 (D.N.D. 1982) affirmed 713 F. 2d 1384 (8th Cir. 1983).
